What is Schedule 26?
Schedule 26 is the updated statutory framework that replaces the former Section 44 requirements under the now-superseded Mines Safety and Inspection Act 1994. These requirements have been modernised and incorporated into the Work Health and Safety (Mines) Regulations 2022, which now govern statutory supervisor appointments on Western Australian mine sites.
Under the transitional arrangements, a competent person may continue to be appointed as a statutory supervisor until 30 March 2026. After this date, anyone performing statutory supervisor duties must meet the full eligibility requirements, including:
Completion of the approved risk management units of competency, and;
Successful completion of the legislation examination.
Note: This course covers the two required Units of Competency; however, statutory supervisors must also pass the separate legislation exam, which is administered by the Department of Energy, Mines, Industry Regulation and Safety (DEMIRS). Full details on the examination and eligibility process can be found on the DEMIRS website.
